1. Who we are
Shan is made by Jack Shi Dan Sun ("Jack", "we", "us"), an independent developer based in Canada. These Terms are an agreement between you and Jack. They cover the Shan app and getshan.com.
By downloading or using Shan, you agree to these Terms. If you don't agree, please don't use Shan. Our Privacy Policy explains how we handle your data.
2. Shan is not medical care
Please read this part first.
- Shan is for everyday eating and general wellness. Its food ideas come from Chinese food tradition, not lab tests.
- Shan doesn't diagnose, treat, cure or prevent any illness, and it isn't medical advice.
- Tongue readings, body types, dishes, drinks and menu picks are made partly by AI (Google Gemini). They can be wrong.
- Allergies and food rules: Shan tries to leave out the foods you tell it to avoid, but it can miss an ingredient, and a menu photo can't show everything in a dish. Always check ingredients yourself and ask the restaurant.
- Talk to your doctor before you change how you eat or try Shan's drinks if you are pregnant, nursing, taking medicine (such as blood thinners) or managing a health condition. Never ignore or delay medical advice because of something in Shan.
- If you might be having a medical emergency, call your local emergency number.
3. Who can use Shan
You must be 18 or older to use Shan. Shan uses Google's AI, whose terms don't allow apps for people under 18. Shan is not meant for children.
4. Your subscription
Shan is free to download. Your first reading and your first cup are free. Your weekly food picks need a subscription.
- One plan. A yearly subscription, bought through Apple. Everything in the app is included.
- Price. The App Store shows the price, in your local currency, before you buy. You pay the price shown at purchase.
- Payment. Apple charges your Apple Account when you confirm.
- Renewal. It renews each year at the same price unless you turn off auto-renew at least 24 hours before the year ends. Apple charges the renewal within the 24 hours before that.
- Cancelling. Any time, in your iPhone's Settings: your name, then Subscriptions. Cancelling stops the next renewal. You keep access until the end of the year you paid for.
- Earlier plans. If you joined on a plan we no longer offer, or at a founding price, it keeps renewing at its own price until you cancel.
- Price changes. If the price changes for current members, Apple tells you first and, where required, asks for your consent.
5. Our 30-day refund promise
If Shan isn't for you, ask for a full refund within 30 days of your first payment. We won't ask why.
- How to ask. In Shan, go to Profile, then Ask for a refund. Or email Jack@getshan.com. Jack replies with the steps. You can also ask Apple directly at reportaproblem.apple.com.
- Who decides. Only Apple can refund App Store purchases. Apple decides under its own policies, and refunds you the way you paid.
- Stopping renewal. A refund doesn't always cancel the plan. Cancel in Settings too, so it doesn't renew.
- After 30 days. Refunds follow Apple's policies.
6. Your data and your photos
How we handle your data is in our Privacy Policy. In short: Shan has no accounts, and most of what you do stays on your iPhone. If you delete the app or lose your phone, that data is gone and we can't bring it back. Your subscription stays with your Apple Account, and Restore Purchases brings it back. Shan sends photos to Google's AI to be read, and uses analytics, including screen recordings that pause on camera and typing screens, to improve the app.
- Your photos stay yours. You give us only the limited permission needed to read a tongue or menu photo and show you a result.
- Your feedback. If you send ideas or feedback, we may use them to improve Shan, with no obligation to you.
7. What you agree not to do
- Use Shan for anything illegal.
- Copy, reverse-engineer, scrape or resell the app, its recipes, its readings or its data.
- Share or resell your subscription.
- Upload anything unlawful, or anyone else's private images.
8. Our content
The app and its text, recipes, artwork (including Bao), seals and data belong to us. We license them to you; we don't sell them. You get a personal, non-transferable licence to use Shan on Apple devices you own or control, under Apple's Usage Rules.
9. Changes and ending
We may change or stop features. We may update these Terms; when we do, the date at the top changes. If you keep using Shan after an important change, you accept it. If you don't, stop using Shan and cancel your subscription.
You can stop using Shan at any time. We may suspend or end your access if you break these Terms.
10. Warranties and liability
Shan is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. We don't promise the app will always work or be error-free, or that any suggestion or AI result will be accurate or lead to any particular result.
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data. Our total liability is limited to what you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't let us limit.
11. Your rights as a consumer
Nothing in these Terms takes away rights you have under the consumer laws where you live. In the EU and UK you may have a 14-day right to withdraw from a digital purchase; because you buy through Apple, you use it through Apple.
12. Apple's terms
- These Terms are between you and Jack, not Apple. Apple isn't responsible for Shan or its content.
- Apple has no obligation to provide maintenance or support for Shan.
- If Shan fails to meet any warranty, you may tell Apple, and Apple will refund the purchase price for Shan. Apple has no other warranty obligation.
- Apple isn't responsible for any claim about Shan, including product liability, legal compliance or consumer protection claims, or for investigating intellectual-property claims.
- You confirm you aren't in a country under a U.S. embargo and aren't on a U.S. list of prohibited parties.
- You must follow any third-party terms that apply when you use Shan, such as your mobile data plan.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13. Law and the rest
These Terms are governed by the laws of Canada, and disputes go to the courts of Canada, without affecting consumer rights that apply where you live.
If part of these Terms can't be enforced, the rest still applies. Apple's Standard EULA covers your licence to use the app; these Terms add Shan's own. Together they are the whole agreement between us. You can't transfer them; we may transfer them to someone who takes over Shan.
